By accessing or using the ReclaimRx Health website, applications, and telehealth services (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Services.

2. Not a Substitute for Emergency Care

IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 OR GO TO THE NEAREST EMERGENCY ROOM IMMEDIATELY.

Our Services are not intended for medical emergencies, urgent situations, or critical care. ReclaimRx Health provides asynchronous and synchronous telehealth consultations for specific, non-emergency conditions.

3. Eligibility

To use our Services, you must be at least 18 years old and physically located in a state where we operate and where our affiliated clinicians are licensed to practice medicine. By using the Services, you represent and warrant that you meet these eligibility requirements.

4. Telehealth Services

ReclaimRx Health provides a technology platform that connects patients with independent, licensed healthcare professionals. We do not provide medical advice or care directly. The clinical services are provided by affiliated medical groups and their licensed providers. You acknowledge that telehealth has limitations compared to in-person care, and your provider will determine if telehealth is appropriate for your specific needs.

5. Subscription and Billing

Certain Services are offered on a subscription basis. By enrolling in a subscription, you authorize us to charge your payment method on a recurring basis (e.g., monthly) until you cancel. You may cancel your subscription at any time through your account settings or by contacting support. Refunds are subject to our refund policy and applicable state laws.

6. Prescription Medications

Prescriptions are issued solely at the discretion of your treating clinician based on their independent medical judgment. There is no guarantee that a consultation will result in a prescription. If prescribed, medications are fulfilled by our licensed pharmacy partners and shipped to your designated address.

7. User Responsibilities

You agree to provide accurate, current, and complete information about your medical history, current medications, and symptoms. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

8. Intellectual Property

All content, design, graphics, text, and software on the ReclaimRx Health platform are the property of ReclaimRx Health or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

9. Limitation of Liability

To the maximum extent permitted by law, ReclaimRx Health and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services. Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any legal action or proceeding arising out of these Terms shall be brought exclusively in the state or federal courts located in Delaware.

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of significant changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
